Looks like the Hammers are getting charged Empty Looks like the Hammers are getting charged

Post by Saintsar Fri Mar 02, 2007 10:37 am

According to the BBC's gossip column this morning, the Daily Express is saying that West Ham will be charged with fielding two ineligible players (Tevez/Mascherano) and could be deducted points.

Is this the final nail in the coffin of West Ham's season? And could there be repercussions for Liverpool now they've signed Mascherano on loan?

The Daily Express website doesn't seem to be running the story, but BBC radio is reporting it. Dunno yet if it's actually true, but it isn't good news for Deano's lot.

I believe (though only because I read it 'somewhere') that the reason it took so flippin long for us to confirm Javi was because we were making absolutely sure there was no chance that problems with WH's original signing of him could affect us.

I seem to recall that the FA even praised us for the way we'd handled the talks with them.

It would seem the problem is compounded by the FA saying Wet H*m didn't supply all the documention pertinent to the transfer. If Liverpool have, there should be no problems with Mascherano.

    So everything's OK then. Whew.

TBH -is a points deduction much of a penalty for West Ham now anyway? Or is relegation a racing certainty?

Mr Magnusson must be congratulating himself on what a superb business deal he did last autumn.

I can't believe how quickly WH have gone downhill. It's deja vu from their last relegation season - you'd think they've got the players to stay up but they just can't make it work somehow.

    Bad luck hammers fans. Sad

Bet that Icelandic guy is kicking himself for ever having bought the club! its like buying C & A!

It would seem that Liverpool, in their attempts to carry out the transfer of Mascherano in a totally correct fashion, sent certain papers regarding MSI ownership of the player to the FA, which wet H*m had failed to send.
Still, as deaño pointed out in the wet h*m thread, spurs had a similar situation, were deducted points, but these points were reinstated on appeal. I didn't know that.

A good point by Roger, any points deduction this season would seem purely cosmetic, not really a punishment, as the 'ammers appear condemn to relegation. Maybe it would be fairer if they were to start next season with any points deduction.

He should be kicking himself for firing Pardew and hiring a manager who's too passive for a (then potential) relegation dogfight (and his record at Charlton). That's what he should be kicking himself over.
Leave the football to the people who know, and if you're going to replace someone, replace them with someone better and fit for that particular task at hand.

    Ok this is the situation....

The league will deduct us points BUT the points will be for next season..which is even worse. They will also throw us out of the FA Cup..Tottenham had exactly the same situation and their points were reinstated and were put back in the FA Cup. The reason for this was that Alan Sugar had bought the club and installed a new manager..

That meant that it would be unfair to prosecute Alan Sugar and the new manager...

Eggurt Magnusson and Alan Curbishley will do the same..the players were not signed under them and therefore our points would have to reinstated on appeal. That is why Terence Brown left the board on Tuesday..because with him as a member of the board we couldn't appeal..

I expect them to charge us and then reinstate the points and us in the FA Cup on appeal ok

Whatever they decide, its farce. I hope you get your points back, or at least don't get deducted next year.

If this (whole affair) doesn't put off clubs from working with MSI, nothing will...

Not that I know of...he's now left the club so really the only thing that can happpen to him...is that he will be sued by Magnusson if the appeal is rejected...

    Source: BBC Football

The Premier League has charged West Ham with breaching their rules in relation to the signings of Argentine duo Carlos Tevez and Javier Mascherano in August.

Tevez and Mascherano joined the club in August, but their registration with third party Media Sports Investment may have broken Premier League regulations.

The Premiership strugglers could be deducted points if they are found guilty of breaching rule U18.

West Ham are 19th in the Premiership, nine points adrift of safety.

A points deduction would almost certainly condemn West Ham to the Championship.

Tevez and Mascherano joined West Ham on 31 August from Brazilian side Corinthians, but the deal was brokered by MSI, who owned the rights to the two players.

The Hammers reportedly failed to hand over vital documentation to the Premier League and have been charged under rule U18 concerning the influence of third-party ownership.

Mascherano has since left the Upton Park club to move to Liverpool.

The Premier League said in a statement: "It is the board's complaint that there were agreements in relation to both these transfers that enabled third parties to acquire the ability materially to influence the club's policies and/or the performance of its teams in League matches and/or the competitions set out in Rule E10.

"The board's view is this constitutes a breach of rule U18.

"Furthermore at the time of the transfer agreements for both Carlos Tevez and Javier Mascherano, and until 24 January 2007, West Ham failed to disclose the third party agreements to the Premier League and/or deliberately withheld these agreements from the Premier League.

"The board's view is this constitutes a breach of rule B13, which states 'In all matters and transactions relating to the League each club shall behave towards each other club and the League with the utmost good faith'.

"West Ham United has 14 days within which to respond to these charges."

What exactly are agents doing then? Or fan clubs for that matter? Or local councils?
