If West Ham schemed on their original agreement with Joorachbian, and usurped the financial rights for Tevez, doesn’t that hold the Hammers liable to a huge lawsuit by Joorachbian, Sheffield United or anyone affected by the Premier League/West Ham chicanery?

YOU MAKE THE CALL
Think whatever you want of the collusion between the Premier League and West Ham. I have one question.
If West Ham schemed on their original agreement with Joorachbian, and usurped the financial rights for Tevez, doesn’t that hold the Hammers liable to a huge lawsuit by Joorachbian, Sheffield United or anyone affected by the Premier League/West Ham chicanery?

There is a thread for this already...
Schemed? It was a different chairman and manager FFS. Magnusson said He would never have sanctioned the deal. The guy had to pay £5.5m out of his own pocket for something he had no control over. Asking for that back is no big deal. Magnusson has said Tevez can discuss things with other clubs. Magnusson has said other clubs need to talk to us.
Man Utd won't talk to us...it's their own problem. We paid £1m plus their wages....plus a fine. So all in all it's costs us about £9m for Tevez and Mascherano. We let Masc go. Tevez we want £5.5m for.

Re: YOU MAKE THE CALL
It would.
But Joorachbian would have seen the papers as it it legally binding for him to have signed the various agreements, the two parties have to sign it, West Ham and the third party offshore company.
The Premier League seen this documentation a while back.
Sheffield Utd had their appeal turned down so West Ham will be in the Premiership no matter what. The question is whether the Court of Abitration will allow Tevez to move from West Ham.

I still don't know how it came about that West Ham are able to control the players movements. Did Kia agree to sign it away? Was it just a gentlemens agreement that WH only own him on paper? It sounds like madness

Kia thought the takeover was 99% done. Hence why he moved them to us. He has gave us their registration...
The clause that we got in trouble for was that he could move them on whenever he likes and that we get a cut of the deal.
Kia wants the clause to still stand...yet wants to give us no money. This is what Magnusson is pissed off about.

I just want to know what the rest of the posters think should happen to the Hammers, Tevez, Premier League, Sheffield United etc.
In your opinion the Mancs should pay you £5.5m and that's it? What about Kia's ensuing lawsuit on West Ham? You know that's a sure thing if the Premier League tells the Mancs to fork the cash to West Ham only. Not only Kia's lawsuit, but the Blades have a legitimate case as well.

No...they don't. The only way we could be docked points was through a dodgy registration. The registration of Tevez and Masc was fine. The problem the PL had was the clause...which cost us £5.5m. Obviously Magnusson did not sanction the deal...simply because he wasn't at the club. We want £5.5m and then we will free Tevez.
@Owen-He is...hence why he put the clause in. However he wants to go back on his word also.

Re: YOU MAKE THE CALL
If you are looking for judgments Puro it's difficult because we just don't know what went on behind the scenes or the finer details of the contract.
What is certain is that the Premier League has done itself a massive disservice letting this deal happen in the first place. They look like dodgy idiots now.

Re: YOU MAKE THE CALL
Sometimes businessmen take risks and they fail in specular fashion, like in this case.
Man Utd will probably have to stump up some from of payment to ease the situation between Joorachbian and West Ham. Then the loan payments will have to be paid. It may end up more trouble than its worth.

Magnusson just wants the £5.5m. Not being funny, if it was him who sanctioned the deal, it would be fair kop and he would let Tevez go. However it wasn't. He could do nothing other than take a punishment for our old chairman.
I don't think asking for the £5.5m (which Kia agreed to in the first place) is any harm. Once he does that...he can move Tevez to Man Utd. Kia is going back on his word...this has pissed off out club big time and it is why we won't let him go.

Yes, but £25M added to our debt is too much (we don't have a budget anymore, if we spend money, it's because we are loaning more).

Surely it will be a loan for two years then a permanent deal at the end of it with a one off payment.Solidus wrote:BTW I certainly don't want to buy him. Has the loan thing been dropped because you don't hear anything about it now.
If you do loan him which I fully expect will happen as you do not have the £25m - £30m to buy him then Joorachbian will be very much involved as he will still own his economic rights. Its only when you by him outright that Tevez will be free of Joorachbians hold.

Puro I'm for hanging white collar bastards that break the rules .. If the Premier League indorsed a deal with Tevez and West ham and took money for whatever they claim? Bring them down..... As for this line regarding business men sometimes step over the line (they should not) if they do hang them... then use lawyers to cover there moves hang that lot too.... West Ham should suck it up. If you buy a club you have to know what is going down Magnusson is no fool. All this just goes to show there is hardly any checks and balances in place The $dollar$ rules........Big shame!

Re: YOU MAKE THE CALL
Ok the previous management broke the rules right and they got Tevez and Masch , ok , the ownership changes ,ok fine and found the deals dodgy but still played Tevez to save themselves? Even they tored the contract up but the deal was dodgy ,looks to me that someone wants the benefits but not the hardships anyway we dont know much about this so nothing makes sense.

Tevez should be sent to play for Sheffield United in the championship to get them promoted. The following year he should move to manu with some kind of fee going to west ham who then have to pay some of it to united to compensate for them being in the championship for 1 year. Everyone's a winner.

I hear you Brian. However, the "Cheneys, Scooter Libbys, Ken Lays" from around the world never get to pay for their scheming ways. The system is in place so they have a get out of jail free card. Cheney can't even get prosecuted for destroying the CIA agent's career (her husband correctly said there were no WMD, but the White House had to "get him" so their Iraq invasion could go on). Many people believe Ken Lay (Enron snake) is not dead.
The top dog in the Premier League/West Ham deal won't get to pay either. These fuckos even when they get caught won't do any time in the big house. White collar crime is no crime in their eyes even though it affects thousands and thousands of people economically, mentally, morally....
