The Tim Howard thing is very different, because he was on loan at Everton all season anyway, and I think EPL rules would therefore have prevented him from playing against Man U for the duration of his loan period. As I remember, the deal to permanently transfer him took place outside the transfer window, so it won't actually go through until this summer, i.e. now.
Maybe there's some clause in loan deals about permanent transfers being able to take place outside of the windows, I dunno. Regardless, Man U tried to get it written into the deal that Howard wouldn't play against them, and the EPL said no, so I can only assume that the gentleman's agreement was then made. Of course, Moyes knew full well that if Man U won the title this season, Everton would get another chunk of money from the Rooney transfer.
