You're forgetting one thing here: van der Vaart plays for the Elftal. And he wanted to stay in the team. He couldn't be 100% sure about his permanent place back then.
Same goes for Gomez, who doesn't even have a permanent place. There's so much competition between the strikers in the Nationalmannschaft at the moment that he couldn't afford to act like an idiot during the season just to bitch his way to Bayern.
Even IF he thought about doing that. Which I highly doubt anyway.

You're forgetting one thing here: van der Vaart plays for the Elftal. And he wanted to stay in the team. He couldn't be 100% sure about his permanent place back then.
